With a little over a week before the new salary threshold test for exempt employees was due to go into effect, a Texas federal court issued a nationwide preliminary injunction on November 22, 2016. This halts the US Department of Labor’s new salary threshold test for exempt employees, and it will not go into effect on December 1, 2016 as planned.
What We Know
The preliminary injunction isn’t permanent; it maintains status quo under the regulations until the court has had a chance to review the merits of the case objecting to the revisions to the regulation.
